Welcome to www.actworthy.org (the “Site”). RZST, LLC (“Owner,” “we,” “us”) is committed to maintaining the privacy and security of your personal information. “Personal Information” means information that identifies you personally, including your name, physical address, email address, phone number, or credit card information. As part of our commitment to the privacy and security of your Personal information, Owner has developed this Privacy Policy to make you aware of our information gathering practices and how we use the information we receive.

By using the Site, you signify your agreement to the terms of this privacy policy (the "Privacy Policy"). If you do not agree to this Privacy Policy, please do not use this Site. Owner may at any time revise the Privacy Policy by updating this posting. If Owner makes such revisions, you will be notified via a popup when you visit the Site notifying you that the Privacy Policy has changed as well as a notation that the Privacy Policy is new next to the link to the Privacy Policy; and if you have provided an email address to Owner, you will also receive an email notifying you there will be updates to the Privacy Policy thirty (30) days prior to any changes. A notice of the last date of revision will always appear at the bottom of this Privacy Policy. Your continued use of the Site constitutes your consent to any updates to the Privacy Policy.

If you wish to make a purchase from the Site, such as by creating an Activist Account (as defined in the Activist Account Terms), please also review the Activist Account Terms, as they set forth the terms for any purchase you make from the Site.

Executive Summary

You do not have to share any Personal Information with us if you do not want to. If you want to create an account, we will ask you for some Personal Information.

We do not share your Personal Information with anyone without your permission.

We do not share information about any actions you have taken without your permission.

We do not share information about you with the government unless we have to due to a court order or other legal process.

We do share some aggregate information about use of the Site with others, including Activist Account holders, but that aggregate information does not identify you personally.

Gathering and Use of Information You Provide to Us

You can visit and browse this Site without telling us who you are or revealing any Personal Information. If you choose only to look at the Site and do not wish to make further use of the functionality of the Site, you need not provide any Personal Information.

If you want to create an Activist Account, save actions to take later, track your actions taken, post actions to social media, allow the Site to make suggestions about what actions you might like to take, allow the Site to reward Activist Account holders for you taking their actions, make donations through the Site, contact other users through the Site, or post to message boards on the Site, you will need to create an account. When you create an account with us, we will ask you for the following Personal Information: first and last name, email address (which will function as your user name), location (city/state/ZIP code), and age range. You may also provide a telephone number if you choose to do so. We will also ask you to create a password for your account. Please see our Terms of Use for further information regarding passwords. This information may be used for various marketing and/or business purposes including but not limited to providing services you have requested, customizing your experience on the Site, resolving disputes, troubleshooting problems, enforcing our agreements with you, market research, and emails from Owner. We will share your Personal Information with affiliates and with our third-party vendors as necessary for these purposes, and you agree that we may do so by creating an account on the Site.

If you have an account, we will also keep track of other information you choose to provide to us, such as which actions you say you have taken or not taken, when you have logged in, issues in which you are interested, and your browsing information. This information will be stored separately from your Personal Information. We will use it to improve your experience of the Site such as by suggesting what actions you might want to take next, for sending you customized emails, and for our research and development purposes.

You may choose to share some of this information with other users, including Activist Account users, on a case-by-case basis. We will not share this information with other users unless you opt into sharing at the appropriate point. We may share aggregate information about the type of users who view an action or event, or take an action or attend an event, with Activist Account holders and other third parties, but this aggregate information will not contain any Personal Information.

It is not possible to make a purchase from the Site or make a donation through the Site during beta testing. We will use a third-party provider for payments after the beta stage is complete.

Gathering and Use of Information Automatically Collected

When you visit the Site, our Web servers may collect some information automatically, such as your Internet protocol address, the identity of your Internet Service Provider, your operating system, when you are logged in, which pages you visit, the source that referred you to our website, what browser you are using, and the time and date of your visit. This information is not linked to Personal Information. This information is used to compile aggregate statistics about the total number of daily visitors to our Site, the pages most frequently visited and how long visitors tend to stay at each page. By collecting this information, we get a better understanding of your preferences so we can continually improve your online experience with us.

Cookies and Web Beacons: Do Not Track

The Site uses cookies, which are small text files that a website can send to a user’s browser for storage on the hard drive. Cookies can make use of the Web easier by saving and administering status, preferences, and other user information. Disclosure on Information We Collect

Owner will disclose Personal Information 1) when you tell us to; 2) in accordance with this Privacy Policy; 3) in order to comply in the event that law requires a disclosure of information submitted to our Site, including when required by a warrant, subpoena or court order; or 4) when we believe in good faith that disclosure is necessary to prevent harm or injury, such as in the event of product recalls, fraud, claims or other liability. Owner does not sell, trade, or rent your personal information to outside parties. Owner may share statistical information about our users, traffic patterns, and related Site information, in aggregate form, with third-party affiliates, potential customers, and vendors, but these statistics will include no Personal Information.

Your Choices Regarding Your Personal Information

If you do not wish to receive information and promotional material from us, you may select the appropriate “opt out” option each time we ask for your Personal Information or when we send you information or promotional material. If you already receive email or direct mail communications from us and no longer wish to receive such communications, please click the “unsubscribe” link in the email or contact us at info@actworthy.org to be removed from our email lists.

Business Transition

The information covered by this Privacy Policy is an asset of Owner and will become part of our normal business records. If Owner or a substantial part of our business is sold or otherwise transferred to a third party, such as a legal successor in interest, your information may be transferred to that third party.

Updating Your Information

If any of the Personal Information you submitted to our Site is inaccurate or outdated or otherwise needs to be changed, please log into your account and update it. You may ask to have the information on your account deleted or removed; however, because we keep track of past transactions, you cannot delete information associated with past transactions on this Site. In addition, it may be impossible to completely delete your information without some residual information remaining because of backups.

How We Secure Your Information

This Site has industry-standard measures in place to protect the loss, misuse and alteration of the information under our control. We use database hashing and restrict access to our database; we store Personal Information separately from usage data in order to ensure your Personal Information is not directly linked to your usage information; and we encrypt all data during transit using HTTPS encryption. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, you acknowledge that: 1) there are privacy and security risks to the Internet which are beyond our control; 2) the security, integrity and privacy of any and all information exchanged between you and us through the Site cannot be guaranteed; and 3) any information or data may be viewed or tampered with by a third party while in transit.

However, these measures standing alone are not sufficient to ensure the security of your Personal Information. It is also important for you to guard against unauthorized access to your passwords and unauthorized use of your computer.

Children

Protecting the privacy of children is very important to us. For that reason, our Site does not intentionally solicit, collect, and/or maintain personally identifiable information from children under age 13. If you are under the age of 13, we ask that you do not submit any Personal Information to us and use this Site only under the supervision of a parent or guardian. If you are the parent or guardian of a person who is a legal minor in your jurisdiction and would like Owner to delete the Personal Information of that legal minor, please contact Owner at delete-minors@actworthy.org, and Owner will delete the legal minor’s Personal Information from our records.

Posts and Comments

Please be aware that when Personal Information is voluntarily disclosed in the discussion forums, message boards, comment sections, or other public areas of this Site, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information. Any submissions to chat rooms or other public areas on this site are accepted with the understanding that they are accessible to all third parties, and this Privacy Policy does not apply to such submissions. If you do not want your comments to be viewed by third parties, you are advised not to make any such submissions. Ultimately, you are solely responsible for maintaining the secrecy of your password and account information. Please be careful and responsible whenever you are online.

Applicable Law

You agree that this Privacy Policy and your use of the Site are governed by the laws of the State of Iowa, without regard to conflict of law principles. You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in Johnson County, Iowa, or the Southern District of Iowa, as applicable, in all disputes arising out of, relating to, or concerning the Site and/or this Privacy Policy. Use of the Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this agreement, including without limitation this paragraph and the warranty disclaimers and liability exclusions contained in the Terms.
